These Terms of Service ("Terms") govern your access to and use of the creator.ly website and services (the "Service"), operated by Awake Corp (주식회사 어웨이크코퍼레이션), a company incorporated in the Republic of Korea (business registration no. 841-88-01897), with its registered office at 537 Eonju-ro (ABT Tower), Gangnam-gu, Seoul, Republic of Korea ("creator.ly", "we", "us").

By creating an account, reserving a handle, or making a payment, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

creator.ly provides, on the creator.ly domain:

Early access. Paying during early access registers your handle to you immediately — in the same way registering a domain takes effect immediately — even though the creator tools built on top of the handle open on the schedule above. Feature launch dates are targets and may shift for technical or operational reasons; your handle registration is not affected by such shifts.

2. Eligibility and accounts

You must be at least 14 years old (or the minimum age of digital consent in your country, if higher) to use the Service. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You may hold multiple handles, but each handle is registered to a single account.

3. Handles

3.1 Allocation. Handles are allocated on a first-come, first-served basis. We may refuse or withhold any handle at our reasonable discretion (for example, handles that are unlawful, deceptive, or reserved for technical reasons).

3.2 Ownership and renewal. A handle remains registered to you for as long as your yearly payment for it is current. While your handle is active, we will never resell or reassign it, and your renewal price will not increase from the price you locked at purchase.

3.3 Cancellation and grace period. If you cancel or do not renew, your handle remains yours until the end of the paid year, and is then held in a 90-day grace period during which it will not be reassigned. After the grace period the handle returns to the public pool.

3.4 Trademark and impersonation. You must not register a handle that infringes another party's trademark or other rights, or that impersonates another person or organization. We may withdraw such a handle after review. If we withdraw a paid handle on this ground, we will refund the unused portion of the current paid year (see the Refund Policy).

4. Fees and billing

4.1 Pricing. Handle pricing depends on the tier of the handle, and is billed once per year:

Early-access pricing applies until public launch (October 2026), and renewals remain at the price you locked at purchase.

4.2 Merchant of record. Payments are processed by Paddle.com Market Ltd / Paddle.com Inc. ("Paddle"), our merchant of record. Your purchase is made from Paddle, which handles payment, applicable taxes (VAT/GST/sales tax), receipts, and billing support. Card details never touch creator.ly servers. Paddle's Buyer Terms apply to your purchase in addition to these Terms.

4.3 Auto-renewal. Paid handles renew automatically every year on your purchase anniversary, at your locked price, until you cancel. You can cancel at any time before renewal — via the link in your Paddle receipt, from your account settings, or by contacting us — and cancellation stops the next charge only; the current paid year continues to its end.

4.4 Platform fees on sales. Separately from the yearly handle fee, when you sell through creator.ly's commerce tools a platform fee applies to each transaction. Fan tips are charged at the same platform fee as sales. The applicable rates are published on creator.ly before the commerce tools open, and take effect only from the date they open. Payment processing costs are included in the platform fee. If you sell nothing and receive no tips, no platform fee is charged.

4.5 Refunds. Refunds are governed by our Refund Policy, which forms part of these Terms.

4.6 Email service and tiers. The email service on your handle — forwarding of incoming mail to an inbox you nominate, and sending as your handle address — is included from the Named tier upward and is not provided on the free Standard tier. Your handle still reserves name@creator.ly on every tier; what is tier-dependent is the service that operates it. Every handle shares the creator.ly domain, so its sending reputation is common to all creators using it, and restricting the email service to paid tiers is a deliverability and anti-abuse measure. We may apply reasonable sending limits, and may suspend or withdraw the email service on a handle used to send spam or otherwise breach section 6 — without that suspension affecting your handle registration or your page.

5. Creator sales and payouts

When creator commerce tools open, you may sell digital products and subscriptions to your audience, and receive tips from them. You are the seller of record for your own products and are responsible for their content, delivery obligations, and legality. Payouts of your sales proceeds (net of platform fees) are transferred to your registered payout account after the applicable refund window for a sale has closed. The payout schedule is published on creator.ly before the commerce tools open.

6. Acceptable use

You must not use the Service to:

We may suspend or terminate accounts and handles that violate this section. Where the violation is material or unlawful, no refund is due for the remainder of the paid year, except where a refund is required by applicable law.

7. Your content

You retain all rights to the content you publish on your page and sell through the Service. You grant us a non-exclusive, worldwide license to host, store, reproduce, and display that content solely to operate and provide the Service. You are responsible for having the rights to everything you publish and sell.

8. Our intellectual property

The Service, including its software, design, and branding, is owned by Awake Corp or its licensors. These Terms do not grant you any rights to our trademarks or branding. Your handle gives you a registration to use the address while active; it does not transfer ownership of the creator.ly domain or any part of it.

9. Service changes, suspension, and termination

We may modify features of the Service over time. We may suspend or discontinue parts of the Service for maintenance, security, or operational reasons. If we permanently discontinue the paid Service, we will give you reasonable prior notice and refund the unused portion of any paid year. You may stop using the Service and cancel renewal at any time.

10. Disclaimers

Except as expressly stated in these Terms or required by law, the Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted or error-free. Nothing in these Terms limits or excludes any statutory warranty or consumer right that cannot be limited or excluded under applicable law, including under the laws of your country of residence.

11. Limitation of liability

To the maximum extent permitted by applicable law: (a) we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or goodwill; and (b) our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. These limitations do not apply to liability arising from our intent or gross negligence, to death or personal injury, or to any liability that cannot be limited under applicable law.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea, without prejudice to any mandatory consumer-protection rules of the country where you habitually reside. Disputes shall be submitted to the competent court under the Civil Procedure Act of Korea, or — where mandatory consumer law so provides — the courts of your place of residence. If you are a consumer, you may also be entitled to use local dispute-resolution bodies (in Korea, the Korea Consumer Agency or the Electronic Commerce Dispute Mediation Committee).

13. Changes to these Terms

We may update these Terms from time to time. For material changes we will give at least 15 days' advance notice (30 days where required by Korean e-commerce regulations) by email or in-Service notice. If you continue using the Service after the effective date, the updated Terms apply. If you do not agree, you may cancel before the change takes effect.
